An Act to amend the domestic relations law and the family court act, in relation to the duration and amount of maintenance and spousal support. The income cap for the formula portion of temporary maintenance awards will be lowered from the current 543,000 to 175,000 of the payor’s income. This cap will also apply to post-divorce maintenance. Child support and Social Security effects the payor’s income cap for purposes of determining the maintenance amount and schedule to the payee. There are numerous other provisions in the law and complex formulas for determining the payor’s cap. Note: The new Temporary Maintenance (Pendente Lite) guideline changes go into effect on divorce actions begun Oct 26, 2015 or after. Post Divorce Maintenance law changes go into effect Jan 25, 2016 or after. Cost of Living Changes go into effect in 2018 or after. |
